A new bill has been introduced in the California legislature by state Senator Tony Mendoza, aimed at protecting senior citizens from unscrupulous elder care referral agencies. Senator Mendoza believes seniors and their families should have access to unbiased information when seeking long-term care, nursing or other types of assisted living services.
The bill, titled SB 648, comes on the heels of growing concerns that a number of California referral agencies have undisclosed financial arrangements with care providers which yield substantial incentives, kickbacks, and bonuses in return for client placements. Senator Mendoza is concerned that these practices prey on senior citizens and their families at a particularly vulnerable time of life, and can result in outcomes that are not in the best interest of the individual requiring care.
To remedy some of the flaws in the existing system, Senator Mendoza has proposed a number of reforms, including a requirement that all California referral agencies disclose any financial relationships with a care provider, including commission or fee structures in place. To further promote quality of life for seniors and older adults, the bill will also require referral agencies to:
- Disclose the frequency in which the recommended facility has been inspected
- Visit patients within one month of new placement
- Safeguard clients’ personal information
- Have current liability insurance policies
